How to Put Justice on Trial

Sure, we have problems.

BIG PROBLEMS.

Our American Way of Life is threatened with New Speak, New Thought, Political Correctness, and threat of a Win with Jurisdictionary!New World Order.
Traditional values of self-reliance, hard work, honesty in business, and genuine patriotism working to promote liberty through justice are still the best protection we have for ourselves and our children.
Individual rights will continue to disappear ... if we do nothing.
ONLY IF WE DO NOTHING. Instead....
  • FORCE your leaders to do what's right.
  • RESTORE the American Dream for yourself, your children, and future generations.
Complaining about a fox in the henhouse doesn't do much for the defenseless chickens. Yet, day-after-day I read posts/emails from people proudly pointing their fingers at "problems" as if doing so will magically make the problems go away.
FIGHT SMART in court and make a difference!
If you want the henhouse safe from foxes, and voting doesn't seem to be working, put ink on court papers and BE HEARD on the official record of your government!
Complaining is getting us nothing.
We are a nation of laws!
Know how to use your power, and whether you have a lawyer or not, you must Organize the Who, What, When, Where and Why of your Concerns.

The always crowd-pleasing session “60 Sites in 60 Minutes” closed the ABA Techshow Saturday as speakers Britt Lorish, Eric Mazzone, Lincoln Mead and Mark Rosch shared their top websites for lawyers.
A few of our favorite sites include:
• Viivo and Sookasa: If you share and store documents in the cloud-based storage system Dropbox, then you’ll want to first encrypt sensitive data using either Viivo (free) or Sookasa (paid).
• The Wirecutter: Need help finding the best tech gadget for you? This website offers helpful shopping tips and reviews on tech products for your practice, home and self.
• CopyPasteCharacter: All of the odd characters you may ever need to type into an email, tweet or mobile document displayed in a single page. Just click, copy and paste.
• Cloudsurfing: Discover and evaluate new web-based services and apps. It even provides screenshots of different user interfaces so that you’ll know what the services are like before you sign up for a demo or purchase.
• Momondo and Skyscanner: Neither website is controlled by hotel or airline companies (unlike other popular travel sites) and offer a wider variety of travel options and hard-to-find deals.
• Byliner: A collection of fiction and nonfiction short stories and long-form articles written by established and promising new writers.
• Meeting Wizard: No more telephone tag! This free service employs simple technology to allow users to send online invitations to plan and schedule meetings and other events, plus propose optional dates, manage responses and send automatic reminders.
• BirthDatabase and TLO: One website can help you to track down information about an individual by supplying the birthdate of more than 120 million names stored in its database. The other is a comprehensive investigative research database that tracks names, aliases, Social Security numbers, addresses, phone numbers (even unlisted ones), relatives, neighbors, assets, driver’s licenses and vehicle info, and email addresses.
• Cue: Have data stored all over the Web in various cloud programs? Cue puts it all together into one interface for easy access.
• AudioName: Is your moniker difficult for others to pronounce? This website allows users to attach personalized audio recordings of their names in emails and on websites so that others don’t commit the awkward faux pas of mispronouncing it in person.
Contact the ABA Law Practice Management section for when materials from this and other Techshow sessions will be available online.

Finding Favor with Judges ...

This may be a "Tough One" to do since so many feel judges are biased.
HOWEVER....

  • Get your way the Right Way!
Having a judge rule against you because he doesn't "like" you isn't a good thing!
It helps to have the judge "on your side".
But!
There's only ONE WAY to get a judge's favor.
  • Know what you're doing, do it well, and don't waste the court's time!
  • Currying favor with flattery doesn't work. Judges get the "sweet treatment" every day. Trying to butter up a judge with flowery words will work against you. The judge won't respect you. The judge will wonder what you're hiding.
  • Challenging a judge's "oath of office" won't win points, either.
  • Nor will arguing over flag etiquette or your name in ALL CAPITAL LETTERS.
Know what you're doing, do it well, AND DON'T WASTE THE COURT'S TIME!
The next case coming up may involve a young child whose mother abandoned him, or a little girl with ugly burn scars on her once-pretty face because an uncle thinks it's fun to extinguish cigars on her cheeks!
  • Learn how to work within the system, instead of trying to make end-runs around the rules with silly games that the judges are quite familiar with already.
  • Learn how to state your position clearly with properly-drafted pleadings, motions, and memoranda.
  • Learn why, how, and when to object with solid grounds the court cannot ignore.
  • Learn how to examine witnesses.
Show the court that you made an effort to learn what justice requires, instead of wasting everyone's time and patience!

To assist one, who may be allegedly accused of abuse or neglect, here is an "Index" of state statute summaries, maintained by the Child Welfare Information Gateway (CWIG):

Abuse & Neglect ~ Adoption ~ Central Registry ~ Court Hearings ~Definitions ~ Domestic Violence ~ Drug Use ~ Foster Children's Bill of Rights ~ Foster Care ~ Home School ~ Immunity ~ Permancy ~ Placement ~ Records ~ Mandatory Reporting ~ Other Resources ~ Righs of Unmarried Fathers ~ Termination of Parental Rights (TPR)

How You Can Avoid The 3 DCF Fair Hearing Mistakes

Hello, thank you for joining me. OR Join the Discussion on LinkIn

My name is Kevin Seaver and I’m a trusted lawyer {Massachusetts} since 1991. I’m a recognized expert, successfully specializing in fighting the department of children and families more commonly referred to as DCF, throughout the entire commonwealth of Massachusetts.

Today I want to talk about avoiding the pitfalls and being successful regarding your DCF fair hearing.

The first, biggest pitfall is failing to file a timely notice with DCF within 30 days of receipt of the letter from DCF saying you as a care taker have abused or neglected a child because if you do not file in a timely fashion you will forever be barred from appealing the allegation of abuse or neglect against you. You must file for a FAIR Hearing within 30 days to the fair hearing office of DCF located at 600 Washington street, 6th floor, Boston mass 02111. This is so critical and important let me repeat that address again. The department of children and families fair hearing unit located at 600 Washington street, 6th floor, Boston mass 02111.

The second biggest mistake I see is that people do not request formal or informal discovery of such things as the report of child abuse and the investigation by dcf that asserts that you have abused a child as well as other witness materials, getting school records, getting any other types of tangible items that will help you to show the fair hearing officer and putting it into evidence.

The third thing that is critical is that many, many, many clients go into the fair hearing unrepresented and they go in and tell their story to dcf’s fair hearing officer. You already told your story once to DC. They supported it against you. You go back in and tell the same story and you’re going to have the same result. They are going to support the allegation of child abuse and or neglect against you by the fair hearing officer. They didn’t believe you the first time DCF, they’re not going to believe you the second time.

DCF allows you to have counsel. Exercise that important fundamental right. Have an attorney, Attorney Seaver represent you. Call me Attorney Kevin Seaver. Call me now at area code (617) 263-2633. Again, call me attorney Kevin Seaver now at area code (617)263-2633. We can help you fight DCF.
Thank you.
